The Justice Department lost a case Monday regarding the 1964 Civil Rights Act and how it relates to gays in the workplace, as a federal appeals court in New York City ruled that the law does apply to anti-gay discrimination.
Judge Gerard Lynch was reportedly opposed to the decision, arguing that Congress did not intend to ban anti-gay discrimination when the legislation was drafted, but “was intended to secure the rights of women to equal protection in employment.”
However, the majority of the court disagreed, and sided with the gay rights argument.
The Hill reported:
"We now hold that sexual orientation discrimination constitutes a form of discrimination 'because of . . . sex,' in violation of Title VII [of the Civil Rights Act of 1964],” the Court of Appeals for the 2nd Circuit said on Monday.
The case concerned a man, Donald Zarda, who claimed he was terminated from Altitude Express, Inc. because of his sexual orientation. Zarda’s lawyers argued that Title VII of the civil rights law applied to gay people.
The Justice Department argued the law prohibited discrimination based on gender, but not on sexual orientation. It also argued that had Congress wanted the law to prohibit discrimination based on sexual orientation, it would have made that specific.
"There is a common-sense difference between sex discrimination and sexual orientation discrimination," an attorney for the Department of Justice told the court last year.
The majority opinion disagreed.
“A woman who is subject to an adverse employment action because she is attracted to women would have been treated differently if she had been a man who was attracted to women,” the majority said in the opinion led by Judge Robert Katzman. “We can therefore conclude that sexual orientation is a function of sex and, by extension, sexual orientation discrimination is a subset of sex discrimination.”

Former Dolphins offensive lineman Jonathan Martin caused a California high school he attended a decade ago to shut down two of its campuses on Friday, after he posted a threatening photo on his Instagram account.
Martin, who had previously been a victim of bullying while playing for the Dolphins, posted a picture of a gun and ammunition, along with a threatening message and several hashtags, including that of his former high school.
Los Angeles Police arrested Martin after discovering the threatening post, and have now revealed that he had a gun on him when they took him into custody.
The New York Post reported:
Law enforcement sources told TMZ Sports that Martin, 28, had a gun in his possession when he was detained by Los Angeles police following the Instagram post that featured a shotgun, shell casings and an ominous warning: "When you're a bully victim & a coward, your options are suicide, or revenge." The post contained the names of former Dolphins teammates, including Richie Incognito and Mike Pouncey, along with Martin's former high school, Harvard Westlake.
Sources told TMZ Sports that police believe Martin recently bought two weapons, including one that matched the gun featured in the Instagram post. That gun was in his car when he was detained Friday.
Martin then checked into a mental health facility, according to the South Florida Sentinel. It's unclear if he was forced to undergo an involuntary medical examination via the Baker Act or if it was Martin's decision.
Martin, who accused teammates, specifically Incognito, of bullying him in 2013, is currently undergoing a psychiatric evaluation, sources told TMZ Sports.

The Navy Seal who killed Osama bin Laden was reportedly removed from an American Airlines flight for being too inebriated to fly.
On Sunday, Rob O’Neill boarded a Dallas-bound plane at an airport in Nashville, Tennessee. According to TMZ, flight attendants noticed prior to takeoff that O’Neill was “extremely” drunk.
Witnesses reported that O’Neill “called an AA employee a vile name and eventually passed out.”
O’Neill woke up prior to the flight’s departure and was ordered off of the plane. He then became belligerent, prompting police to board and escort him off of the plane.
O’Neill was formerly a member of SEAL Team Six, which raided Osama bin Laden’s secret compound in Pakistan in May 2011. The Al Qaeda leader was killed by shot fired by O’Neill.
He also participated in the 2009 mission to rescue the crew of the Mearsk Alabama after they were taken hostage by Somali pirates. The incident was dramatized in the movie “Captain Phillips” which starred Tom Hanks.
After retiring from the military in 2012, O’Neil waited two years before he identified himself as the SEAL who killed Bin Laden.
O’Neill is a conservative who supported President Donald Trump in the 2016 presidential election, but he has also praised former President Barack Obama.
“He made the right call with Captain Phillips and he made the right call with bin Laden,” O’Neill said of Obama in 2015. “The two times I've been directly associated with a decision that he made, he made the right call.”

In an effort to prohibit Russian interference in the 2018 midterm elections, the State Department unveiled a new $40 million program on Monday.
According to Steve Goldstein, undersecretary at the State Department, the initiative will counter state-sponsored disinformation and propaganda targeting the U.S. and its interests, USA Today reported.
The State Department’s Global Engagement Center will administrate the program that is launching with a $1 million Information Access Fund which will eventually grow to $5 million. On Monday, the center announced a request for proposals from agencies and groups across the United States.
“Under the Information Access Fund, civil society groups, media content providers, non-governmental organizations, federally funded research and development centers, private companies and academic institutions will be eligible to compete for grants from the GEC to advance their important work to counter propaganda and disinformation,” read a statement released Monday morning.
Additional defense funding will allow the Global Engagement Center to establish a series of pilot projects developed in partnership with the Department of Defense.
Congress ordered the effort last summer in response to Russian interference in the 2016 presidential election and to battle ongoing Russian efforts to influence U.S. politics.
After acknowledging that obtaining the funding took longer than expected, Goldstein insisted that the delay “hasn’t inhibited the Global Engagement Center from doing its job” of countering state-based initiatives to effect the U.S. political conversation.
“This administration takes that very seriously,” he said.
USA Today reported, “The State Department’s first step to combatting Russia’s information operations is essentially to crowdsource how to do it. The Kremlin uses a range of methods, ranging from publishing inaccurate or misleading articles to employing people to create fake and automated social media accounts on Twitter, Facebook and other social media to sow confusion and discord in the U.S.”
Goldstein said, “We’re open to fund any program that’s effective. It requires many different methods to make a dent in this issue — algorithms, TV, radio, social media… working with tech companies. It is not merely a defensive posture that we should take; we also need to be on the offensive."
Acknowledging that the approach is “not something we’ve done before,” Goldstein said that State Department officials want to make certain not to overlook efforts that might prove successful.
“There are people out there with great ideas,” Goldstein said. “This is their opportunity.”

"Fire and Fury" author Michael Wolff walked off the set of Australia’s morning talk show “Today” after claiming that he was unable to hear questions regarding his now-retracted claim that President Donald Trump has had an affair while serving in office.
Soon afterward, footage from “Today’s” London studio emerged which revealed that Wolff was able to hear the the questions, which were asked by host Ben Fordham.
Wolff claimed that the equipment was malfunctioning as he was being questioned regarding his January claim that he was "absolutely sure" that Trump was having an affair in the White House. Wolff also signaled that the president was conducting the dalliance with U.S. Ambassador to the United Nations Nikki Haley, an allegation she called "disgusting."
In a Thursday interview on Dutch television, Wolff claimed not to have knowledge regarding such an affair, The Daily Caller reported.
"I do not know if the president is having an affair," said Wolff, whose book about the Trump White House has been proven to be riddled with errors and inaccuracies.
On Australia’s “Today” show, Fordham urged Wolff to apologize for his erroneous allegation.
"You said during a TV interview last month that you are absolutely sure that Donald Trump is currently having an affair, while president, behind the back of the first lady. I repeat, you said you were absolutely sure," Fordham began.
"Hold on, I can't …," Wolff said as he adjusted his earpiece.
Fordham continued, "Last week, you backflipped and said, 'I do not know if the President is having an affair.' Do you owe the president and the first lady an apology, Mr. Wolff?"
"I can't hear you. Hello?" said Wolff.
"Just last month you said you were absolutely sure that the president was having an affair, and now you say he is not," Fordham said.
"I'm not getting anything," Wolff said as he removed his earpiece.
Fordham pointed out that Wolff had no trouble hearing him until the tough questions were asked.
"Mr. Wolff was hearing me before, but he's not hearing me anymore … so the interview may be over," he said.
Wolff is then shown leaving the London set.
Not long after the segment ended, "Today's" London studio shared audio which revealed that Wolff was fully capable of hearing Fordham's questions.
"That appears to be the audio coming through the earpiece on Mr. Wolff's end … which would suggest that he could hear you loud and clear," said another "Today" anchor.
"So he could hear me!" Fordham declared. "He decided to tell a porky pie about not being able to hear me," he said, using Cockney slang for lying.

Democrat Terry McAuliffe, formerly Virginia’s governor and chairman of the Democratic National Committee, declared recently that he would be the party’s best choice to “take on” President Donald Trump in 2020.
“Who better to take on Trump than me?” McAuliffe told The Washington Free Beacon.
McAuliffe, who is regularly included on the crowded roster of Democratic presidential hopefuls, is reportedly “seriously considering” a presidential run. Even so, he has not yet confirmed his intent, and recently dodged a question from CNN’s Jake Tapper regarding the best candidate for the 2020 race. McAuliffe declined to name himself, but did contend that former governors with executive experience, such as his own, are better suited for the presidency.
Because he has known Trump for a long time, McAuliffe believes he is equipped to stand up to the president, who contributed $25,000 to McAuliffe’s unsuccessful 2009 campaign for governor of Virginia.
According to McAuliffe, he has “golfed with Trump five times.” Calling Trump a “scratch golfer,” McAuliffe said he never saw Trump cheat when they played together, casting doubt on accusations by others that Trump cheated on the course.
In a January interview with MSNBC’s Chris Matthews, McAuliffe acknowledged that Trump has the ability to make his opponents “look weak,” but declared that if Trump attempted to do that to McAuliffe, “you would have to pick him up off the floor.”
Matthews then asked McAuliffe if he was saying that he would “deck” Trump. McAuliffe replied, “Listen, if this guy got in my space, you wanna get in my space, I've always said Chris, you punch me, I'm going to punch back twice as hard. And it wouldn't be hard to do it, but you know, this guy thinks he could intimidate everybody. It's disgraceful. It's embarrassing.”
Regarding the Democrats’ focus, McAuliffe said that it “ought to be on 2018, and if people are interested in running for president, you got to look at January, February, or March of 2019.”
“Your focus, if you really care about the principles and values of our party, you better be working hard,” he said. “That’s why I’m traveling all over this country to help these governors’ races, doing events for House candidates.”
McAuliffe previously served as campaign chairman for the presidential bids of Bill and Hillary Clinton.
Politico reported that McAuliffe speaks with former President Bill Clinton every day and that the two have “talked in passing about a White House run.”

Officials in the Trump administration are finalizing a new measure aimed at reversing an Obama-era deal which loosened sanctions on Iran’s top terror organization.
In 2016, the Obama administration relaxed prohibitions on allowing business transactions with companies associated with Iran’s Revolutionary Guard Corps by establishing new language regarding what constituted IRGC “control” of such entities.
In light of the fact that the deaths of hundreds of Americans are attributable to the IRGC, the Obama administration’s back-door concession to Iran incited outrage among lawmakers and pro-Israel groups, and inspired the Trump administration to lobby to have the IRGC declared a terror organization.
According to The Washington Free Beacon, “A new congressional bid will now seek to revise that standard for IRGC ‘control,’ reversing a portion of Obama-era sanctions relief that has helped Iran fund its massive military intervention in Syria and other regional hotspots. The push is already said to be gaining support from the American Israel Public Affairs Committee, or AIPAC, the United States’s leading pro-Israel lobbying group, which will support the new effort during its annual policy conference in Washington, D.C., next month.”
AIPAC’s conference is expected to attract tens of thousands of supporters who will lobby in favor of the legislation and other related initiatives aimed at constraining Iran’s burgeoning influence in the region. The group will also support a measure to provide Israel with new munitions to assist the country in its efforts to counter Iran.
A veteran congressional adviser who was briefed on AIPAC’s initiatives said, “This has been a longtime coming. The Obama administration used every last trick to loosen sanctions on Iran, even hiding concessions in online FAQs and then claiming nothing had changed when they got caught, which is what happened in fall of 2016.
“AIPAC and Congress both called out the back-door sanctions relief at the time and said they’d pursue legislative fixes,” the source said. “A few months later the Trump transition team started taking over and pursuing fixes, and now it’s back over to Congress to put everything into law. AIPAC knows where the bodies on this one are buried, and will be providing invaluable policy and political advice.”
A senior Trump administration official said that the administration and Congress are seeking to send a clear message to the world that Iran is not open for business, despite the Obama administration’s efforts to encourage renewed trade.
“What we saw in Iran in late December and early January was the extreme dissatisfaction of the Iranian people with an economy that’s being run to service the military, not to help the Iranian people,” the official said. “What tightening this will do is make it clear the U.S. stands with the people of Iran, not the IRGC.”
Earlier in February, White House National Security Adviser H.R. McMaster delivered a speech in Munich in which he warned companies that were conducting business with the IRGC. In response, top Iranian officials accused McMaster and the United States of violating the nuclear deal.
“Don’t do business with the IRGC; don’t enrich the IRGC; don’t enable their murderous campaign; don’t enable their threat to our friends in the region and to—especially Israel but also Saudi Arabia and others,” McMaster said. “It’s in everyone’s interest to really work hard on business intelligence to understand who are the beneficial owners of these companies who were, you know, opening up checkbooks and doing business with in Iran.”

In a major setback to the Trump administration Monday morning, the Supreme Court rejected a request to hear the federal government’s arguments against a ruling by the 9th Circuit Court of Appeals which had temporarily blocked the Trump administration from ending Obama’s Deferred Action for Childhood Arrivals (DACA) program for illegal aliens.
The program protects illegal aliens from deportation who were brought to the U.S. as children, and allows them to get work permits.
USA Today reports:
The program had faced a March 5 deadline for congressional action set by Trump last summer. Two federal courts have ruled the administration’s action was illegal.
The justices could have agreed to hear the case this spring, leapfrogging a federal appeals court based in California that has been sympathetic to the cause of immigrants. They also could have overruled federal District Judge William Alsup without a hearing.
Instead, they simply allowed the case to run its normal course through the appeals court, which it asked to “proceed expeditiously.” The case still could come to the high court in the future.
The action represents a temporary victory for the young adults brought to the U.S. illegally by their parents or guardians under the Deferred Action for Childhood Arrivals program established by President Barack Obama in 2012.

The Archbishop of Canterbury recently confused citizens of the United Kingdom by taking inconsistent positions on the acceptance of Sharia law into British society, according to Jihad Watch.
Archbishop Justin Welby declared on Sunday that Sharia is incompatible with British law, but insisted that those in the U.K. must allow themselves "to change with the newcomers and create a deeper, richer way of life."
In an opinion editorial published by the Daily Mail titled "Brexit and a broken Britain: The Archbishop of Canterbury says the inequality and division in the UK is our 'greatest challenge since WW2,’" Archbishop Justin Welby wrote, “Welcoming strangers to our country and integrating them into our culture is important. We must be generous and allow ourselves to change with the newcomers and create a deeper, richer way of life. We also need to support strongly those poorer communities that have had high levels of immigration.”
Prior to the publication of the op-ed, Welby said last week that Sharia law should never become part of the British legal system.
According to the Daily Mail, Welby contended that the Islamic rules are incompatible with Britain's laws, which have developed over 500 years on the principles of a different culture.
Welby asserted that high levels of immigration from Muslim countries can “have an impact on the accepted pattern for choosing a partner, on assumed ages of maturity and sexual activity, and especially on issues of polygamy.”
Conversely, Welby said that British law has “underlying values and assumptions” that come from a clearly Christian tradition. “Sharia law is not just about punishments,” he added. “It is something of immense sophistication, but it comes from a very different background of jurisprudence to the one from which British law has developed over the past 500 years.”
In a recent book, the Archbishop wrote that the arrival of a large numbers of Muslims in the United Kingdom — approximately 3.3 million — has led to a challenge of the values of the majority population including the right of people to choose their own spouse and the need for monogamous relationships.
“There has been and remains a demand for the introduction of those aspects of Sharia law that affect family and inheritance,” Welby wrote.
“The problem is reimagining Britain through values applied in action can only work where the narrative of the country is coherent and embracing,” Welby said. “Sharia, which has a powerful and ancient cultural narrative of its own, deeply embedded in a system of faith and understanding of God, and thus especially powerful in forming identity, cannot become part of another narrative.
“Accepting it in part implies accepting its values around the nature of the human person, attitudes to outsiders, the revelation of God, and a basis for life in law, rather than grace, the formative word of Christian culture.”

As the gun control debate rages on, National Rifle Association (NRA) spokeswoman and conservative commentator Dana Loesch has made it clear she disagrees with President Trump’s proposal to raise the age limit on purchasing firearms.
Trump has recently touted that he will seek legislation to boost the age of being able to legally purchase a rifle to 21. Loesch feels this is a step backward.
The Hill reports the following:
“National Rifle Association (NRA) spokeswoman Dana Loesch stressed during an interview on Sunday that the NRA does not support raising the age to purchase long guns to 21, pushing back on comments by President Trump.
“So the position is you do not want to raise the age?" host George Stephanopoulos asked Loesch on ABC’s “This Week.”
"That's what the NRA came out and said. That's correct," Loesch said.
Trump said last week following the Florida high school massacre that the legal age to purchase all guns should be raised to 21. The White House later said that he meant semi-automatic weapons.
Loesch echoed Trump, however, in saying that arming teachers could deter school shootings.
"If parents and teachers voluntarily choose to be armed, I think that’s something schools will have to come up with and determine for themselves," Loesch said.”

The state senate of Georgia passed legislation last week giving agencies the right to turn away LGBT couples seeking to adopt a child.
The Hill reports the following:
“The Georgia Senate has passed a measure that gives adoption agencies the right not to work with LGBTQ couples.
The bill was sponsored by state Sen. William Ligon, a Brunswick Republican, and was passed by a vote of 35 to 19 last week, The Associated Press reported.
It applies to adoption agencies in the state that receive taxpayer funding.
Those who support the bill say it would allow for faith-based organizations to take part in government programs.
“Just because you are a faith-based organization, doesn’t mean you have to check your faith at the door and cannot participate in government programs,” Ligon said, according to WRAL.com.”

This past weekend saw one of the biggest attendance turnouts for the annual Florida Gun Show in Tampa.
The large turnout is reportedly in response to the gun control debate waging across the nation following the school shooting in Parkland, FL.
The Daily Mail reports the following:
“The Florida Gun Show had never seen a crowd as big as the one it saw this weekend, according to organizers.
Almost 7,000 people showed up to The Florida Gun Show in Tampa this weekend, nearly two weeks after a gunman killed 17 teachers and students at a high school in the state.
‘Some of the people attending are afraid that future legislation will impact their gun ownership rights,’ manager George Fernandez told WTSP.
Indeed, the gun business becomes more profitable after mass shootings, as gun owners become afraid of public backlash causing restrictions to their Second Amendment rights.
For example, the share price of gun makers tends to spike immediately after mass shootings. That is because of speculation that consumers would be more eager to buy up guns in the short term before the government would introduce legislation restricting gun sales, according to Business Insider.”

While the gun control debate rages on, President Trump’s daughter and advisor Ivanka has chimed in with her own opinion regarding arming teachers.
According to sources, Ivanka is in favor of holding discussions that include training educators with firearms, similar to her father’s recent proposal.
The Daily Mail reports the following:
Ivanka Trump said on Sunday that her father’s proposal of placing firearms in the hands of highly trained teachers is an option worth debating.
During an interview with NBC News in Pyeongchang, South Korea, Trump was asked if she would be comfortable knowing that a teacher educating one of her three children was in possession of a gun in the classroom.
‘To be honest, I don’t know,’ Trump said. ‘Obviously, there would have to be an incredibly high standard for who would be able to bear arms in our school. But I think there is no one solution to creating safety.’
The President’s eldest daughter was then asked if she would be advising the commander-in-chief on the issue, which he proposed earlier this week via Twitter.
‘I think that having a teacher who is armed who cares deeply about her students or his students and who is capable and qualified to bear arms is not a bad idea, but it is an idea that needs to be discussed,’ Trump added.

If you watch my daily program called The Truth (M-F, 11am ET, Facebook.com/DMLdaily) then you know that many months ago I predicted Michelle Obama would run for president in 2020. Considering my political predictions often come true, this is a concern.
As I’ve noted on several occasions, the Democrats are hungry to win back the White House, but for Obama it would be extra important as Trump continues to chip away at Obama’s legacy.
Assuming the president keeps to his promise of never granting amnesty and if he can find a way to repeal and replace Obamacare, then there isn’t much left to the Obama presidency that lasted 8-years. Thus, Michelle and her husband may feel the need to enter the race.
One of the co-hosts on THE FIVE, which airs on Fox News, believes Obama can win the election if she runs in 2020. He also believes Trump is vulnerable to lawmaker Kamala Harris, and TV icon Oprah Winfrey.
Juan Williams in an op-ed for The Hill, writes: “The three strongest Democratic challengers to President Trump's reelection are now all black women.
They are talk show queen Oprah Winfrey, former first lady Michelle Obama and Sen. Kamala Harris (D-Calif.).
Although I disagree with him about Harris being a threat, I do believe Obama and Oprah are highly dangerous. Especially Obama! She will want to enter the White House to not only protect her husband’s legacy, but she’ll aim to be the first female, and the first black female to be elected president.
Although Williams is a liberal and will push the narrative that Trump can’t win, there is a certain level of truth to what he says. The GOP and Trump wold be foolish to not take the threats seriously. Thus, all the more reason why Trump has to address Obamacare sooner than later, and he has to stop the nonsense about granting amnesty to the Dreamers. Both of these topics are critical for his continued success.

On Facebook, the brother of the Parkland school shooter posted a status appreciating the positive feedback he has been receiving since Nikolas Cruz, 19, shot and killed 17 people.
Zachary Cruz, 18, wrote the following via social media: “Appreciate all the positive messages [heart emoji].”
The Daily Mail reports the following:
The post made by the account under the name of ‘Zachary Cruz,’ has led to speculation that the 18-year-old has broken his silence, following his 19-year-old brother’s admission to shooting and killing 17 people.
‘Appreciate all the positive messages [heart emoji],’ the post read, which was published on Saturday at 11.06pm Eastern.
The profile photo for the account was posted on Sunday at 4.24am ET, and appears to show a young Zachary Cruz with his half-brother.
The features of the two children in the photo appear very similar to a picture taken between November last year and January which shows them holding the ashes of their adoptive mother, Lynda Cruz.
There’s no way to tell through public access when the Facebook account was created. DailyMail.com messaged the account, but did not receive a reply.”

Jonathan Swan has ties to the White House. Swan is a writer for left-leaning website, Axios. According to Swan’s article on Monday, the president is pushing for his personal pilot to head the FAA.
Swan writes: “Trump has told a host of administration officials and associates that he wants John Dunkin — his longtime personal pilot, who flew him around the country on Trump Force One during the campaign — to helm the agency, which has a budget in the billions and which oversees all civil aviation in the United States.”
In his article Swan says that an industry insider mocks the mere idea of Trump’s pilot leading the agency, going as far as equating it to a Seinfeld episode.
Swan claims that a Trump administration source says Dunkin is a good fit.
